Watch Party Contest Rules

This contest is open to Canadian residents only and is GOVERNED by Canadian law.

Standard data rates apply to participants who choose to participate in the Contest via a mobile device.  Please contact your service provider for pricing and service plan information and rates before mobile device participation. 

1) CONTEST PERIOD:

The Indspire Awards Contest (the “Contest”) begins on May 12, 2023 at 12:00:00 a.m. Eastern Time (“ET”) and ends on June 30, 2023 at 11:59:59 p.m. ET (the “Contest Period”). 

2) ELIGIBILITY:

Contest is open to residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Indspire (the “Sponsor”), its associated and affiliated entities, prize suppliers, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfillment of the Contest (collectively with the Sponsor, the “Contest Parties”).

3) AIR CANADA NOT INVOLVED:

The Contest is in no way sponsored or administered by Air Canada.  Air Canada is hereby completely released of all liability by each entrant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Air Canada.  

4) HOW TO ENTER: 

NO PURCHASE NECESSARY. To obtain the Official Contest Entry Form (the “Entry Form”) during the Contest Period, go to www.indspire.ca/watch-party (the “Website”).  Next, fully complete the Entry Form with all required information and signify your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”).  Once you have fully completed the Entry Form with all required information and agreed to the Rules, follow the on-screen instructions to submit your completed Entry Form to be eligible to earn one (1) Entry (each, an “Entry” and collectively the “Entries”).  To be eligible, your Entry must be submitted and received in accordance with these Rules during the Contest Period.

5) HOW TO EARN ONE (1) BONUS ENTRY:

After you have earned your Entry in accordance with Rule 4, there are two (2) ways to earn a maximum of one (1) Bonus Entry (a “Bonus Entry”) as follows:

  • Watch the Indspire Awards: Celebrating Indigenous Achievement on June 18, 2023 and then click on the link in the email sent to you by the Sponsor to complete the survey. After fully completing and submitting the survey, you will automatically earn one (1) Bonus Entry.

OR

  • To obtain one (1) Bonus Entry in the Contest without completing the survey, print your first name, last name, telephone number and complete mailing address (including postal code) on a plain white piece of paper and mail it (in an envelope with sufficient Canadian postage) along with a 25 word or more unique and original essay on the importance of Celebrating Indigenous Achievement to: Indspire, 555 Richmond Street West, Suite 601, Toronto, ON M5V 3B1 (the “Request”). Upon receipt of a valid Request submitted and received in accordance with these Rules, you will be eligible to receive one (1) Bonus Entry. To be eligible, the Request you submit must: (i) be received separately in an envelope bearing sufficient Canadian postage (i.e. multiple Requests in the same envelope will be void); and (ii) be post-marked during the Contest Period and received prior to the Draw Date (as defined below in Rule 9).

6) ENTRY LIMIT:

There is a limit of one (1) Entry per person during the Contest PeriodThere is a limit of one (1) Bonus Entry per person during the Contest Period (regardless of the method of entry). If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Entry; (ii) obtain more than one (1) Bonus Entry (regardless of the method of entry); and/or (iii) use multiple names, multiple identities, multiple email addresses, and/or any automated, macro, script, robotic or other system(s) or program(s) and/or any other means not in keeping with the Sponsor’s interpretation of the letter and/or spirit of these Rules to enter or otherwise participate in or to disrupt this Contest; then they may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  Your Entry and/or Bonus Entry (collectively, a “Contest Entry” and the “Contest Entries”) may be rejected if (in the sole and absolute discretion of the Sponsor) the Entry Form/Request is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period.  The Contest Parties, Air Canada and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) are not responsible for (and have no liability in relation to) late, lost, misdirected, delayed, incomplete or incompatible Contest Entries or Requests (all of which are void).

7) VERIFICATION:

All Contest Entries are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Contest Entry, Request and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) used by the Sponsor.

8) THE PRIZE:

There will be a total of one (1) prize (the “Prize”) available to be won.  The Prize consists of two (2) Economy Class round trip promotional tickets for travel to any Air Canada scheduled destination in North America.  Tickets are valid for travel on Air Canada, Air Canada Express and Air Canada Rouge scheduled flights only (not valid on Star Alliance partners or code sharing carriers). Space is subject to availability.  Reservations must be booked no later than June 1, 2024 and travel must be completed by no later than June 30, 2024.

The approximate retail value of each Prize will vary based on the destination selected by the confirmed winner as well as based on other factors – but will generally be approximately $2000 CAD.  Prize is subject to the terms and conditions set-out below in Schedule A (the “Prize Terms and Conditions”).

Without limiting the Prize Terms and Conditions, the following general conditions also apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted except at Sponsor’s option; (iii) the confirmed winner and their guest (the “Guest”) must: (a) have all necessary documentation to permit travel (including, if required, transborder or international travel); and (b) travel on the same itinerary; (iv) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed winner and their Guest; (v) if the confirmed winner and/or their Guest do not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vi) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; and (vii) by accepting the Prize, the confirmed winner and their Guest both agree to waive all recourse against Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

Guest Requirements: The confirmed winner’s Guest must: (a) either be of the legal age of majority in their province/territory of residence or have the express written consent (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed winner; and (b) sign (and have their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence) and return the Sponsor’s form of declaration and release by the date indicated on the release form, indicating (among other things) that they waive all recourse against the Sponsor and all of the other Released Parties relating to their participation in the Prize (including, without limitation, any travel related thereto).

It is strongly recommended and encouraged that the confirmed winner of the Prize and their Guest obtain sufficient personal travel and medical insurance prior to departure.

The Sponsor and the other Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of the Prize. Neither the confirmed winner, nor their Guest, nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein.

9) ELIGIBLE WINNER SELECTION PROCESS AND ODDS OF WINNING:

On July 17, 2023 (the “Draw Date”) in Toronto, ON at approximately 12:00 p.m. ET, one (1) eligible entrant will be selected by random draw from among all eligible Contest Entries submitted and received in accordance with these Rules.  The odds of winning depend on the number of eligible Contest Entries submitted and received in accordance with these Rules.

10) ELIGIBLE WINNER NOTIFICATION PROCESS:

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the eligible winner (using the information provided on the Entry Form) within five (5) business days of the Draw Date. If the eligible winner cannot be contacted as outlined above, or if there is a return of any notification as undeliverable; then they may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Contest Entries submitted and received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such newly selected eligible winner).

11) ELIGIBLE WINNER CONFIRMATION PROCESS:

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS THEM AS THE WINNER IN ACCORDANCE WITH THESE RULES.  Before being declared AS THE CONFIRMED PRIZE winner, the eligible winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within ten (10) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Sponsor and all of the other Released Parties from any and all liability in connection with this Contest, their participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of their name, city and province/territory of residence, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.  If the eligible winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then they will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Contest Entries submitted and received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such newly selected eligible winner). 

12) GENERAL CONDITIONS:

This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.  ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Released Parties will not be liable for: (i) any failure of the Website or any other website, platform or device during the Contest; (ii) any malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Contest Entry, Request and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above.

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.   The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.   Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

For Quebec residentsAny litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://indspire.ca/privacy-policy/).  This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance by any entrant, Contest Entry, Request and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the French version of these Rules, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.  The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to this Contest.

Terms and Conditions

  1. Reservations must be booked no later than June 1, 2024 and travel must be completed by no later than June 30, 2024.
  2. Tickets are valid for travel on Air Canada, Air Canada Express and Air Canada Rouge scheduled flights only (not valid on Star Alliance partners or code sharing carriers).
  3. Flight reservation is subject to availability.
  4. Unless decided by Air Canada in its sole discretion, the bearers of the tickets will be responsible for any and all costs, surcharges, fees, expenses and taxes not expressly described herein including, without limitation, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layovers, meals and beverages, service charges, in-flight meals and entertainment; costs incurred to and from the departure point; obtaining sufficient personal travel insurance prior to departure, if desired; obtaining and carrying all necessary travel documentation, such as passports and visas, proof of vaccination against COVID-19, adequate proof of negative COVID-19 test and complying with entry, health, customs and immigrations regulations and requirements.
  5. Your ticket is not transferable, not upgradeable, not refundable, and not redeemable for cash nor valid on Air Canada Vacations packages.
  6. Should you decide to cancel your booking for whatever reason, Air Canada cannot issue a replacement promotional code.
  7. Extensions for the above-mentioned travel booked by and travel completed by deadlines are not permitted under any circumstances.
  8. Travel does not qualify for Aeroplan points accumulation or for mileage/points accumulation in any other frequent flyer program.
  9. Stopovers, multi-city or one-way itineraries are not permitted.
  10. The use of upgrade credits and/or e-Bids is not permitted. Upgrading to Business Class or Premium Economy is not permitted unless you opt to purchase a last-minute upgrade at your own expense through the Last Minute Upgrade Purchase as further described at https://www.aircanada.com/ca/en/aco/home/book/upgrades/last-minute-upgrade- purchase.html#/

  12. Air Canada Signature Class may not be available on all flights.
  13. Entry into the Maple Leaf Lounge is not permitted unless flying Business Class.
  14. Promotional pass recipients may be held liable to Air Canada for failure to adhere to the restrictions and conditions of travel applicable to their tickets or for the fraudulent use of those tickets.
  15. Your promotional code may not be distributed or sold, or otherwise used for commercial or personal gain, other than for the purpose for which it is intended. Air Canada reserves the right to modify or cancel this promotional code at its discretion. Any violation of these conditions may be subject to cancellation of the promotional code, of any booking made using this promotional code, and/or to any legal or other recourse available for the recovery of damages suffered or costs, expenses or loss incurred as a result of such prohibited use.
